A federal judge is giving a massage therapist two weeks to adequately allege a commercial sex act in her sex trafficking lawsuit naming entertainment mogul James Dolan and disgraced film producer Harvey Weinstein — or face permanent dismissal of her claims in federal court.
In a new ruling obtained by Rolling Stone, the judge agreed with Dolan’s lawyers that plaintiff Kellye Croft’s first amended complaint, filed in April, is “devoid” of the necessary threshold allegations that Dolan coerced her into a commercial sex act with something of value, such...

Disgraced movie mogul Harvey Weinstein filed an appeal to overturn a rape and sexual assault conviction in Los Angeles, California, on Friday, NBC News reported, weeks after he successfully overturned a similar conviction in New York. Weinstein has requested a new trial.
“Harvey Weinstein was tried by a system devoted to ‘getting him’ at all costs,” his publicist Juda Engelmayer told NBC News in a statement. “This appeal demonstrates nearly a dozen areas of brazen legal missteps that violated his right to a fair trial.” In the filing, Weinstein’s...

Terius Gesteelde-Diamant, a songwriter and producer for Beyoncé and Rihanna, has been sued for rape, sexual battery and sex trafficking by a former mentee.
In a lawsuit filed on Tuesday in California federal court, Chanaaz Mangroe accuses Gesteelde-Diamant (also known as The-Dream) of falsely promising to promote her career only to trap her in an “abusive, violent and manipulative relationship filled with physical assaults, violent sexual encounters, and horrific psychological manipulation.”
Gesteelde-Diamant has been behind a number of hits, including Beyoncé’s “Single Ladies” and “Break My Soul,” Rihanna’s “Umbrella,” Jay-Z and Justin Timberlake’s “Holy Grail,” Mariah Carey’s “Touch My Body” and Justin Bieber’s debut single “Baby,” among others. This year, the eight-time Grammy winner was shortlisted for an Academy Award after writing an original song for the remake of The Color Purple. As he took the stage at the BET Awards in June 2022 to receive a Lifetime Achievement Award, Sean “Diddy” Combs was elated. “Yeah, yeah, yeah, yeah, yeah, yeah, yeah, yeah!” he bellowed, punctuating his words with triumphant jumps. The adoring crowd — who gave him a sustained standing ovation — included his mother and children, longtime friends, and music-industry peers Kanye West, Janelle Monáe, Babyface, and Lil Wayne. After three decades of relentless hustling that took him from hungry teenage intern to A&r executive, producer, label impresario, respected fashion designer, and household brand name,...

Sean “Diddy” Combs posted a short apology video Sunday morning, two days after a harrowing hotel surveillance video showed him assaulting his ex-girlfriend Casandra “Cassie” Ventura. Looking directly at a camera, the mogul says he was at his “rock bottom” when he attacked Ventura in the hallway of the InterContinental Hotel in Los Angeles in 2016. In the surveillance video, obtained by CNN, Combs is seen throwing, kicking, stomping and dragging Ventura.

Sean “Puffy” Combs won’t be prosecuted for beating up Casandra Ventura despite hotel surveillance footage showing the 2016 assault, says the Los Angeles District Attorney.
“We are aware of the video that has been circulating online allegedly depicting Sean Combs assaulting a young woman in Los Angeles” George Gascón said late Friday, a few hours after CNN’s May 17 exclusive of the horrific hallway assault at Century City’s now-closed InterContinental Hotel dropped.

Cassandra Ventura’s short-lived rape and abuse lawsuit against her former long-term boyfriend Sean “Puffy” Combs was settled in November, but a 2016 surveillance video reveals just how horrific the rap mogul could be to the singer. In fact, despite constant denials of various accusations of abuse, Combs himself must know how damning the footage is because he allegedly bought it for $50,000 the day after the incident in Los Angeles.
In the graphic clip obtained exclusively by CNN (see it here), Combs is seen with a towel around his waist in a corridor of a Century City hotel. He grabs the back of Ventura’s hoodie and hurls her to the floor, then kicks and appears to drag her back toward their room. Later, she picks up a hotel phone, and Combs returns and appears to shove her. The clip also appears to show a then-seated Combs throwing an object in Ventura’s direction.

Back in 2020, former Hollywood producer Harvey Weinstein was convicted of sexually assaulting Miriam Haley, a production assistant on Project Runaway; this happened in 2006 and when the conviction arrived in 2020, it was the first major moment of the #MeToo movement. The once-great and influential producer was disgraced and in 2022, a second conviction – for a rape that happened in Los Angeles – arrived and added to Weinstein’s total jail sentence.
The producer, of course, filed an appeal and the New York Cour of Appeals ruled, with a thin (4-3) majority decision that Weinstein’s due justice rights were breached when the original judge, James Burke, decided to allow testimonies by women that were not directly related to the case at hand. This is why the conviction was overturned and a new trial was ordered, although Weinstein will – luckily – remain in jail due to the other conviction.

Harvey Weinstein’s accusers slammed the decision to overturn his New York rape conviction, saying it’s “profoundly unjust” and a “major step back.”
The New York Court of Appeals overturned Weinstein’s 2020 rape conviction on Thursday in a 4-3 decision, ruling that the trial showed prejudice to him by allowing women to testify about allegations that were not part of the case. Weinstein will now face a new trial.
“The news today is not only disheartening, but it’s profoundly unjust,” said the Silence Breakers, a group of Weinstein survivors, in a statement. “But this ruling does not diminish the validity of our experiences or our truth; it’s merely a setback. The man found guilty continues to serve time in a California prison. When survivors everywhere broke their silence in 2017, the world changed. We continue to stand strong and advocate for that change. We will continue to fight for justice for survivors everywhere.

Harvey Weinstein’s 2020 rape conviction has been overturned by the New York Court of Appeals.
On Thursday, the court found in a 4-3 ruling that the judge in Weinstein’s trial — a landmark moment in the #MeToo movement that the 2017 allegations against him started — had shown prejudice by allowing women to testify about allegations that were not part of the case. The court has now ordered a new trial.
Weinstein, the Oscar-winning producer of “Shakespeare in Love” and “Good Will Hunting,” is serving a 23-year sentence at the Mohawk Correctional Facility, a medium-security prison in Rome, N.Y. He will remain imprisoned as he was also convicted of rape in Los Angeles in 2022 and sentenced to an additional 16 years in prison. However, Weinstein was acquitted in the Los Angeles trial on charges involving a woman who testified in his New York case.
Weinstein spokesperson Juda Engelmayer said in a statement: “We’re cautiously excited.

Sean “Diddy” Combs’ lawyer says the music mogul cooperated with authorities after his homes were raided by federal agents, but adds that “there was a gross overuse of military-level force” used when the raids occurred.
A month after Combs was sued for sex trafficking and other allegations, agents raided the Grammy winner’s homes on Monday in Los Angeles, New York and Miami. A representative for Homeland Security Investigations New York said in a statement that the raids were executed “as part of an ongoing investigation, with assistance from Hsi Los Angeles, Hsi Miami and our local law enforcement partners.”
On Tuesday, Combs’ attorney, Aaron Dyer, called the raids “gross” and said the “unprecedented ambush [was] paired with an advanced, coordinated media presence.”

Officials raided two of Sean Combs’ homes on Monday, a law-enforcement source confirmed to Rolling Stone, as part of a federal sex-trafficking investigation. Led by Homeland Security, the raid was carried out just four months after the rap mogul’s ex-girlfriend, singer Cassie, accused Combs of sex trafficking.
Helicopters and agents were seen swarming Combs’ Los Angeles mansion on Monday afternoon. Footage of the scene appeared to show some men — later identified as Combs’ sons Justin and King — detained and waiting outside of the Holmby Hills house. Officials were also present at Combs’ Miami residence.

Sean Combs has filed his first official challenge to claims he “gang raped” a 17-year-old girl at his Manhattan recording studio in 2003. In new court paperwork submitted Tuesday, Combs refuted accusations that he, his longtime lieutenant Harve Pierre and a third unidentified man trafficked the teen across state lines, plied her with “copious amounts of drugs and alcohol” and took turns raping her in a bathroom of his Daddy’s House Recording Studio.

An unidentified woman who sued Jimmy Iovine for sexual assault and battery has dropped her lawsuit against the Interscope Records cofounder.
A lawyer representing the accuser notified the court on Thursday that the case is “discontinued in its entirety with prejudice,” meaning it cannot be refiled. It is unknown if a settlement was reached.
In a statement, Douglas Wigdor, a lawyer for the woman, said “the matter was resolved to the satisfaction of the parties.”
Iovine did not immediately respond to requests for comment.
In November, an unnamed woman sued Iovine for assault, battery and violations of the state’s gender-motivated violence and human rights laws. She alleged she was “sexually abused, forcibly touched, and subjected to sexual harassment and retaliation” by the music mogul in August 2007 while she was contracted with Interscope, according to court filings.
Only the summons was brought. Lawyers for the accuser said a complaint would be filed,...

A former masseuse filed a federal lawsuit on Tuesday, alleging that she was coerced into having sex with James Dolan and was also sexually assaulted by Harvey Weinstein.
The woman, Kellye Croft, alleges that Dolan pressured her to have sex after a massage appointment while she was working on an Eagles tour in 2013. She alleges that Dolan ignored her resistance and then summoned her to his room several more times on the tour, pressuring her to have sex.
The suit also alleges that Dolan arranged for her to meet with Weinstein, who, she alleges, sexually assaulted her at the Peninsula hotel in Beverly Hills in 2014. The suit accuses Dolan of sex trafficking.
According to the suit, Croft told Dolan shortly after the Peninsula incident that Weinstein had been “sexually aggressive.” Dolan responded that Weinstein was a “troubled person” who had “serious issues,” but that his friends were trying to get him to address them,...

Exclusive: Two months after Julia Ormond sued CAA, Disney and Harvey Weinstein for negligence, breach of fiduciary duty, battery and more over an alleged 1995 sexual assault by the now incarcerated Weinstein, the agency and the Bob Iger-led corporation say they shouldn’t be a part of the suit and want out.
“Accepting the allegations in the Complaint as true, Harvey Weinstein’s alleged misconduct is disturbing and deplorable,” a filing Tuesday by Disney’s New York lawyers Cravath, Swaine & Moore asserts of Ormond’s October 4 complaint. “But the question is whether Plaintiff’s allegations are sufficient to state a claim for negligent supervision against Twdc,” it adds, in respect to the company’s ownership of the Weinstein’s’ Miramax from 1993-2010.

The surge of sexual-abuse lawsuits that hit some of the music industry’s most powerful figures last week isn’t over yet, several lawyers tell Rolling Stone.
Last week, as the window for New York’s Adult Survivors Act (Asa) was nearing a close, it brought forward one of the widest sets of allegations to hit the industry in years as renowned artists and executives including Axl Rose, Sean “Diddy” Combs, L.A. Reid, and Jimmy Iovine all faced lawsuits that detailed allegations of sexual abuse.

A series of high-profile figures in Hollywood are being sued ahead of a deadline to file lawsuits under a New York law that suspended time constraints on claims involving allegations of sexual misconduct for one year.
At the top of the list of defendants who are expected to be sued or were named in complaints filed Wednesday and Thursday in New York’s state Supreme Court: Sean “Diddy” Combs, Axl Rose, Cuba Gooding Jr., Jamie Foxx and Jimmy Iovine. On Tuesday, Bill Cosby was also sued in another suit from a woman claiming the actor drugged and sexually assaulted her in the 1980s.
Plaintiffs, who typically would’ve been constrained from suing under the statute of limitations, have been taking advantage of New York’s Adult Survivors Act, which revived the window to bring sexual misconduct claims for one year. It closes at midnight Thursday. This month, suits were filed against Combs,...

A woman is filing a lawsuit against music executive Jimmy Iovine, alleging the Interscope Records co-founder sexually abused her and forcibly touched her, according to court documents. Iovine tells Rolling Stone he’s “shocked and baffled” by the claim.

If it seems like the music industry is facing a moment of reckoning — this month, lawsuits were filed against Sean “Diddy” Combs, music mogul L.A. Reid and ex-Grammys CEO Neil Portnow — it might be, but it’s likely that these cases are making headlines all at once because a New York law that suspends time constraints on claims involving alleged sex offenses is about to expire.
All three of those high-profile cases were filed under New York’s Adult Survivors Act, which opened a one-year lookback period during which civil claims that would have otherwise been barred by the statute of limitations could be filed.
The window opened on Nov. 24, 2022 — E. Jean Carroll’s defamation suit against former President Donald Trump was amended almost immediately to include a sexual abuse claim — and it closes at midnight on Thursday.

Sean “Diddy” Combs and Cassie have settled a lawsuit that she filed one day ago, accusing the hip-hop mogul of repeatedly raping and physically abusing her for nearly a decade.
“We have decided to resolve this matter amicably,” Combs said in a statement. “I wish Cassie and her family all the best. Love.”
In another statement, Combs’ lawyer, Benjamin Brafman, clarified that the decision to settle is in “no way an admission of wrongdoing.” He added, “Mr. Combs‘ decision to settle the lawsuit does not in any way undermine his flat-out denial of the claims. He is happy they got to a mutual settlement and wishes Ms. Ventura the best.”
Cassie reportedly added in a statement, “I have decided to resolve this matter amicably on terms that I have some level of control. I want to thank my family, fans, and lawyers for their unwavering support.”

Former Bad Boy recording artist Cassie has settled a lawsuit filed against Sean Combs that accused the music mogul of rape.
The settlement came one day after singer Casandra Ventura filed a lawsuit against Combs that claimed the Bad Boy Entertainment mogul raped and beat her over a period of a decade.
“I have decided to resolve this matter amicably on terms that I have some level of control. I want to thank my family, fans and lawyers for their unwavering support,” Ventura said in a statement distributed Friday evening by her attorney, Douglas Wigdor of Manhattan-based Wigdor Law, reports variety.com.
On Thursday, Combs’ team is characterized the suit as the result of an unsuccessful shakedown attempt by a former girlfriend.
On Friday, in a statement also distributed by Wigdor, Combs said: “We have decided to resolve this matter amicably. I wish Cassie and her family all the best.

Update, 7:52 Pm: Just over 24 hours after Cassandra Ventura filed a rape and abuse lawsuit against her former longtime boyfriend Sean Combs, the singer and the music mogul ended the incendiary matter.
“I have decided to resolve this matter amicably on terms that I have some level of control,” Ventura a.k.a. Cassie said in a statement late Friday of the federal court case that rocked the music biz on November 16 (see below for more details). “I want to thank my family, fans and lawyers for their unwavering support.” The mega-producer also known as Diddy added with brevity: “We have decided to resolve this matter amicably. I wish Cassie and her family all the best. Love.”
On Thursday there was back and forth talk between Ventura and Diddy’s lawyers of “eight-figure” offers to Cassie to keep quiet and allegations that the plaintiff had sought $30 million from Combs to not go public.

R&b singer Cassie, the longtime romantic partner of Sean “Diddy” Combs, has filed a lawsuit against him in Manhattan’s Federal District Court.
The complaint alleges that the rapper, producer and music mogul who founded Bad Boy Records, raped and subjected Cassie to years of aggressive behavior and physical abuse.
Cassie, whose real name is Casandra Ventura included Bad Boy Entertainment, Bad Boy Records, Epic Records, Combs Enterprises, and Combs Enterprises LLC as defendants in her lawsuit, and alleges that whenever she tried to hide, Combs’s network of corporations and affiliated entities would locate her.
Ventura asserts that Combs pressured her to consume illegal drugs and forced her to carry firearms in her purse on his behalf. Additionally, she alleges that when the two were on a break for a period, Combs arranged for the destruction of fellow musician Kid Cudi‘s car, whom Ventura was in a relationship with at the time.

Rapper Sean “Diddy” Combs has been accused of rape and sex trafficking by a female singer named Casandra Ventura. In a lawsuit, ex-girlfriend Ventura said she was trapped for a decade in a cycle of abuse and violence, reports bbc.com.
Combs, who has also gone by the stage name Puff Daddy, denies the allegations, accusing the singer of trying to extort him. His lawyer said the claims were “offensive and outrageous”.
Ventura, an R&b singer and dancer who performs under the stage name Cassie, claimed that the rap producer raped and beat her over 10 years starting when she was 19 and he was 37.
“After years in silence and darkness, I am finally ready to tell my story,” she said in a statement on Thursday.
The lawsuit includes multiple graphic descriptions of the violent abuse that she says occurred beginning after she met the rapper in 2005.

Sean “Diddy” Combs has been accused of rape and intense physical and psychological abuse by his long-time former girlfriend, Cassandra Ventura.
Cassandra Ventura’s lawyers allege that Sean Combs tried to pay her off with an eight-figure settlement in order to keep things quiet. “Mr. Combs offered Ms. Ventura eight figures to silence her and prevent the filing of this lawsuit,” Doug Wigdor told Deadline. “She rejected his efforts and decided to give a voice to all woman who suffer in silence. Ms. Ventura should be applauded for her bravery.” In response, Combs’ attorney Ben Brafman said that his client “vehemently denies these offensive and outrageous allegations.“
Not only that, but Brafman added that Ventura had allegedly been threatening Combs for the last several months, all while demanding money. “For the past 6 months, Mr. Combs, has been subjected to Ms. Ventura’s persistent demand of $30 million, under the threat of...

Sean Combs, the hip-hop mogul known as “Diddy,” has been sued for sexual assault by his former longtime partner Cassie, who accused him of repeatedly raping and physically abusing her for nearly a decade.
In a lawsuit filed in New York federal court on Thursday, Cassie, whose real name is Casandra Ventura and was once under Diddy’s label, claims that she was “trapped by Mr. Combs in a cycle of abuse, violence and sex trafficking,” citing multiple incidents in which he allegedly “punched, beat, kicked and stomped” her. Diddy’s Bad Boy Records and Sony’s Epic Records were also named in the complaint.
The suit is the latest in a series of legal actions filed against prominent men in the music industry, including ex-Grammys CEO Neil Portnow and former Epic Records chief Antonio “L.A.” Reid, under the New York Adult Survivors Act, which revived the window to...

Sean “Diddy” Combs has been sued by his former girlfriend and label signee, the singer Cassie, for rape and years of repeated physical abuse.
The New York Times reports that Cassie, born Casandra Ventura, filed the suit in Federal District Court in Manhattan Thursday (November 16th). Ventura met Combs — fka Puff Daddy — in 2005 when she was 19, and signed with the record producer’s label, Bad Boy.
Bad Boy released Ventura’s debut album the following year. The suit claims that Combs then roped her into what would become a years-long cycle of controlling and abusive behavior, which included beating her, forcing her to take “copious amounts of drugs,” and filming her having sex with a cast of multiple male prostitutes — which he referred to as “freak-offs.” Because these staged acts of voyeurism occurred in multiple cities, the suit classifies it as sex trafficking.

Casandra Ventura, who’s best known as the R&b singer Cassie, filed a lawsuit against hip-hop mogul Sean Combs Thursday, alleging he raped and physically abused her over the course of a decade. The suit, obtained by Rolling Stone, claimed that the abuse began in 2005, when Combs allegedly began plying a then 19-year-old Ventura with alcohol and drugs. Ventura also accused Combs of beating her and forcing her to have sex with male prostitutes, which she claims he filmed while masturbating. She alleged he raped her after forcing his...

CAA had been silent all day Wednesday since Julia Ormond named the uber-agency and Disney in her sexual battery lawsuit against the imprisoned Harvey Weinstein, but tonight the Bryan Lourd-led company is calling its inclusion in the action “baseless.”
In fact, CAA stopped just short of citing the claim of breach of fiduciary duty by their former client as a shakedown of sorts.
“CAA takes all allegations of sexual assault and abuse seriously, and has compassion for Ms. Ormond and the experience she described in her complaint,” an agency spokesperson said tonight. “However, the claims that Ms. Ormond has levied against the agency are completely without merit. Through counsel, Ms. Ormond approached CAA in March with these allegations about the agency. Knowing these allegations to be untrue, the agency then retained attorney Loretta Lynch and her law firm, Paul Weiss, to defend the company. Their review found nothing to support Ms.

As Harvey Weinstein’s sentencing looms and Danny Masterson moves toward a retrial, a new phase in #Metoo-era litigation is underway in New York as a result of the state’s Adult Survivors Act — and a case involving former president Donald Trump is one of the first to test its limits.
The Asa was signed by Gov. Kathy Hochul on May 24, and effectively suspends time constraints on claims involving sex offenses for a one year period that began on Nov. 24. The lookback window in the Asa is similar to that in the state’s Child Victims Act, which was first signed into law on Feb. 14, 2019 and resulted in more than 10,000 lawsuits.
Gibson Dunn litigator Brian Ascher notes that courts “tend to get a bunch right away and then a lot right at the end of the period.”

In September 2002, Kaja Sokola was a 16-year-old model newly arrived in Manhattan from her native Poland. While attending an event whose guest list was curated by her agency — Next Model Management, one of the biggest and most successful modeling firms in the world — the 5’11” teen with a dream of becoming an actress met movie producer Harvey Weinstein. He was 50 years old at the time and at the height of his power and influence. She was living apart from her parents for the first time.

A former top editor of the New York Post has filed a lawsuit against the New York Post, alleging that she endured years of sexual harassment by former longtime editor Col Allan, but was demoted and dismissed following her complaints about it.
Michelle Gotthelf was fired last week, according to her lawsuit, after a 21-year career at the publication, most recently as editor in chief of NewYorkPost.com. Allan also was named in the lawsuit along with current editor in chief Keith Poole, as well as Nyp Holdings and parent company News Corp.
A spokesperson for the Post and News Corp. said in a statement, “Any suggestion of wrongdoing related to the management changes announced today is meritless.”

Update (4/12): A grand jury indicted Harvey Weinstein on 11 counts of sexual assault, the Los Angeles Times reports. The indictment doesn’t feature any new charges and was reportedly part of a procedural move to skip a preliminary hearing and make sure the trial itself can move quickly (Covid-19 has created a massive backlog of cases in the Los Angeles court system).
The new indictment comes as Weinstein appeared in a New York court for a hearing about his extradition to Los Angeles for the trial there. As Deadline reports,...

San Francisco, March 2 (Ians) A senior-level manager at Amazon has filed a lawsuit against the tech giant, alleging race and gender discrimination at the workplace.
The lawsuit was filed by Charlotte Newman in the district court in Washington, D.C. on Monday, USA Today reported.
She alleged that she was hired for a position which was a level lower than the position she originally applied for despite having the necessary qualifications.
According to her attorney Douglas Wigdor, Newman accepted the "Level 6" public policy manager position at Amazon after she was told that her responsibilities would be limited to US-related domestic policy work.
However, within months Newman was carrying out responsibilities related to "Level 7" international-based work outside of the US, said the lawyer.
The "de-levelling" has cost Newman hundreds of thousands in pay, argued the lawyer.

An Amazon manager Charlotte Newman has sued the giant company for racial discrimination in hiring and accused several executives of abusive behavior and sexual harassment.
In the expansive lawsuit filed Monday in District Court in Washington, D.C. (read it here), Newman, a former aide to Sen. Cory Booker, alleges the company hired her for a position that wasn’t commensurate with her experience in order to pay her less, a practice called “de-leveling” that she claims is common for Black managers. She performed work above her grade, she says, and was passed over for promotions that were given to less qualified white male candidates. She claims the treatment made her appear vulnerable and a target of harassment by other executives.

A Delaware judge Tuesday denied a motion by some victims of jailed former mogul Harvey Weinstein to convert The Weinstein Company’s bankruptcy proceeding from Chapter 11 to Chapter 7, allowing the long process to move forward. Chapter 7 can dispense with classes of creditors – of which abuse victims are one in this case — and allow individuals to pursue claims separately.
The attorney representing nine victims argued at a hearing this morning that the Chapter 11 plan so far encompasses much too large a group of abuse claimants — possibly in the thousands — with too wide a range of claims from rape to workplace intimidation. That would dilute recovery of the $17 million allocated for sexual misconduct for those who had suffered the most. It would also deprive them of an ability to bring their case to a jury.

The Time’s Up Legal Defense Fund is supporting a sexual harassment lawsuit filed against Fox News and several of its anchors, including Tucker Carlson and Sean Hannity.
The organization — which was founded in the wake of the #MeToo movement — is providing PR support to Cathy Areu, a former unpaid Fox News contributor who alleges she faced a “barrage of sexual harassment” at the network.
Fox News has pushed back aggressively on Areu’s claims, releasing messages that appeared to contradict her initial account and threatening to seek legal sanctions if her allegations were not withdrawn.
Areu and Jennifer Eckhart, a former associate producer at the network, filed suit on July 20 in federal court in New York.
Eckhart alleged that Ed Henry, the veteran correspondent and anchor at the network, had violently raped her at a hotel room in 2017. She also accused Henry of psychologically manipulating her and asking her to be his “sex slave.

Once thought blocked, the long road to a global settlement for victims of Harvey Weinstein got a green light of sorts today in federal court.
A Delaware judge Wednesday allowed attorneys for debtors to start contacting potential Weinstein victims who might want to file claims in the more than two-year-old bankruptcy case of the imprisoned mogul.
The move at a hearing by Judge Mary Walrath in U.S. Bankruptcy Court in Delaware unlocked a step in the process. It didn’t address a controversial revised settlement that emerged overnight Tuesday, which was excoriated by attorneys of some victims. That settlement shrank the pot of cash available to victims but also eliminated a payout to reimburse Weinstein’s legal costs.
On the legal costs, “Judge Hellerstein called that obnoxious, and we heard that,” said Paul Zumbro of Cravath, Swaine & Moore, speaking for debtors at the hearing, referring to U.S.

(Updated with Weinstein lawyer statement) A new proposal to settle sex crimes claims against Harvey Weinstein should be Doa, lawyers representing several of the now incarcerated producer’s victims say.
“Filed in the middle of the night to avoid attention, the latest Weinstein settlement plan is more offensive than the version that was rejected by Judge Hellerstein,” attorneys Douglas Wigdor and Kevin Mintzer said this morning (read the plan here). “Under the new plan, which is approximately $10 million less than the plan rejected by Judge Hellerstein, more than half of the settlement funds are paid to Robert Weinstein and the other ultra-wealthy former directors of The Weinstein Company, as well as TWC creditors including huge media companies and famous actors.”

A new settlement proposal to close out the bankruptcy of The Weinstein Company includes a reduction in payouts to accusers compared to a previous plan.
The revised $35.2 million proposal designed to close out TWC’s financial obligations includes a $17 million victims’ fund — a decrease from a settlement proposal filed and rejected in July, which included an $18.9 million victims’ fund that would allow women from both the TWC and Miramax era to make claims, as well as a $5.4 million settlement for 14 individual victims as part of the liquidation of TWC.
The Tuesday filing, reviewed by TheWrap, said that the $35,214,882.30 proposed settlement, to be paid out by insurance companies, would be divided as such: “(i) the aggregate Cash amount of the Sexual Misconduct Claims Fund; (ii) the aggregate Cash amount to the Estates in the amount of the Liquidation Trust Settlement Payment; (iii) the aggregate Cash amount of the Former Representatives Defense Costs.
